1. Agreement to Terms
By accessing and using Trenchers.net (the "Site"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you are prohibited from using or accessing this site. These terms govern the sale of all heavy machinery, compact equipment, and attachments provided by Trenchers.net.
2. Product Information & Specifications
We strive to ensure that all equipment specifications, operating capacities, and attachment compatibilities listed on Trenchers.net are accurate. However, machinery designs and specifications are subject to change by manufacturers without prior notice. We do not warrant that product descriptions, technical guides, or other content on this site are error-free, complete, or current.
3. Pricing & Typographical Errors
All prices are listed in USD and exclude applicable taxes, freight, and transport fees unless otherwise explicitly stated. In the event a product is listed at an incorrect price due to a typographical error or an error in pricing information, Trenchers.net reserves the right to refuse or cancel any orders placed for the product listed at the incorrect price.
4. Shipping, Freight & Risk of Loss
Heavy machinery requires specialized commercial freight. All items purchased from Trenchers.net are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the freight carrier. It is the buyer's responsibility to inspect all equipment for transport damage before signing the Bill of Lading (BOL).
5. Warranties & Exclusions
New equipment purchases may be covered by a standard manufacturer's warranty. Warranties generally cover core components such as engines and hydraulic pumps against manufacturing defects. However, standard warranties strictly exclude standard wear-and-tear parts. Trenchers.net is not responsible for the replacement of consumable parts under warranty, including but not limited to:
- Trencher chains, sprockets, and digging teeth (cup, shark, or rock bits).
- Excavator tracks, tires, and undercarriage wear components.
- Filters, fluids, and standard maintenance items.
6. Limitation of Liability
In no event shall Trenchers.net, its directors, employees, or suppliers be liable for any indirect, incidental, special, or consequential damages arising out of the use or inability to use the equipment sold. This includes damages for loss of profits, job site delays, loss of data, or physical injury resulting from the improper operation or inadequate safety training of the machinery.
7. Operating Licenses & Compliance
The purchaser assumes all responsibility for ensuring that operators of the equipment purchased from Trenchers.net possess the necessary commercial driver's licenses (CDL), safety certifications, and training required by local, state, and federal laws. Trenchers.net assumes no liability for the unlawful or unsafe operation of heavy machinery.
8. Intellectual Property
All content included on this site, such as equipment infographics, text, graphics, logos, images, and technical manuals, is the property of Trenchers.net or its content suppliers and protected by copyright and intellectual property laws. You may not extract or utilize parts of the content without our express written consent.
9. Modifications to the Terms
Trenchers.net reserves the right to revise these Terms and Conditions at any time without notice. By using this website, you are agreeing to be bound by the then-current version of these Terms and Conditions.
10. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of the jurisdiction in which our primary warehouse operates, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.
